Minor Audio, Video, and Photographic Release Agreement

This Minor Audio, Video, and Photographic Release Agreement (this “Agreement”) is made effective for all purposes for the 2025–2026 swim season by Parent/Guardian in favor of Bend Swim Club, Inc., an Oregon nonprofit corporation (“Club”), and all present and future Club directors, officers, employees, volunteers, assignees, partners, contractors, representatives, and agents, and all successors and assigns of each of the foregoing persons and/or entities (collectively “Released Parties” and individually a “Released Party”).

Club offers adults and children the opportunity to participate in certain swimming and related activities, classes, training, events, and/or competitions (individually and collectively, “Club Activities”). In consideration of Club permitting Swimmer to participate in any Club Activities, Swimmer and Parent/Guardian acknowledge and agree to the following:

Parent/Guardian and Swimmer grant the Club permission to use, publish, and distribute photographs, video, and/or audio recordings taken by or of the Swimmer before, during, and/or after any Club Activities (individually and collectively, “Media”). Parent/Guardian and Swimmer grant and convey to Club all rights, title, and interest in the Media.

This includes the right to use Swimmer’s name, image, or likeness for lawful purposes including, without limitation, training, evaluation, development, publicity, illustration, advertising, marketing, and web content. The Club may edit, alter, copy, exhibit, or publish the Media. Parent/Guardian and Swimmer waive the right to inspect or approve the final use of such materials and waive any right to compensation related to such use.

All use of Media will be consistent with USA Swimming’s Safe Sport policies, including guidelines regarding appropriate use and protection of minor athletes. Media will never be used in a manner inconsistent with athlete safety or privacy standards.

If you do not wish for your swimmer’s name or likeness to be used in Club Media, you may notify the Club in writing at the time of registration.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PARENT/GUARDIAN AND SWIMMER HEREBY JOINTLY AND SEVERALLY VOLUNTARILY WAIVE, RELEASE, FOREVER DISCHARGE, AND AGREE TO HOLD HARMLESS, DEFEND, AND INDEMNIFY CLUB AND ALL OTHER RELEASED PARTIES FOR, FROM, AND AGAINST ANY AND ALL LIABILITIES, DAMAGES, CLAIMS, DEMANDS, COSTS, PROCEEDINGS, ACTIONS, AND EXPENSES OF EVERY KIND, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES AND COSTS, WHICH MAY ARISE DIRECTLY OR INDIRECTLY IN CONNECTION WITH THIS AGREEMENT AND/OR THE RELEASE PROVIDED HEREIN.

This Agreement will be governed by and construed in accordance with the laws of the State of Oregon, and venue for any action concerning this Agreement will lie in Deschutes County, Oregon. Each provision contained in this Agreement will be treated as a separate and independent provision. The unenforceability of any one provision will in no way impair the enforceability of any other provision contained herein. Any reading of a provision causing unenforceability will yield to a construction permitting enforcement to the maximum extent permitted by applicable law.

By completing this registration process, I represent that (a) I am Swimmer’s custodial parent or legal guardian, (b) I have legal authority to sign this Agreement individually and on behalf of Swimmer, and (c) I have read, fully understand, and agree to the above provisions and I acknowledge that Club is relying on such understanding and agreement in permitting Swimmer to participate in Club Activities.

I execute this Agreement for myself (individually) and Swimmer on a joint and several basis, and our respective personal representatives, executors, assigns, heirs, spouse, parents, siblings, and children.
